“Keeping ’em Honest” AC 360: Is Warren Jeffs’ conduct with a 12 year old girl “having sex” or a “sexual assault”?

Did any of you catch last night’s coverage of the Warren Jeffs’ trial on CNN’s AC 360, specifically when Anderson Cooper and reporter Gary Tuchman referred to the defendant’s conduct with a 12-year-old girl as “having sex” when they reported the prosecutions playing of Warren Jeff’s 20 minute audio recording of his “heavenly session” with the victim, his 12-year-old wife? Really, is that “keeping em honest”? “Having sex” with a 12-year-old girl, in all states, is a “sexual assault” or a “rape”, it is not “having sex”. Yes, a bit technical, but, the characterization does matter, especially when you are dealing with a case about the (alleged) rape, “sexual assault”, of two young girls.

Just keeping it honest, WHAT SAY YOU?

    What is the difference, legally, between sexual assault and sexual molestation? Jill

    • Good question. Sexual assault usually refers to rape (penetration) and sexual molestation usually involves physical touching of a sexual nature of child under 14 in most states. For instance, molestation typically includes touching, groping or foundling of private parts. Warren Jeffs could certainly have been charged with a lesser charge of molestation as well but since the grand jury found two counts of penetration, he was indicted on sexual assault (rape) of a child under 17 and aggravated (child under 14) sexual assault (rape) of a child. Many people believe that the “spiritual marriages” are nothing less than rape of children, a horrendous form of child abuse.
